Karen K. Clampitt has 27 years experience with the U.S. Department of Labor, Employment Standard Administration, Wage and Hour Division, where she retired as the Assistant District Director. Karen has extensive experience in the laws and regulations that apply to businesses and governments, including the Fair Labor Standards Act, Family and Medical Leave Act, labor standards associated with various government contracts and laws applicable to agricultural employers.  She holds a B.A. in Psychology from Louisiana State University , Baton Rouge , Louisiana .  She joined LCC in 2006.

Overview of Responsibilities

As an Investigator, investigations of private and public employers to determine and enforce compliance with various laws enforced by the Wage and Hour Division were conducted. Engaged in informational programs such as workshops and seminars and conducted surveys to gather labor statistical information. 

As the Assistant District Director duties involved recruiting, training and supervising Investigators and clerical staff and conducting potential complex civil and criminal litigation cases.

As a Consultant for Labor Consultants Central, services have been performed for employers in the public and private sectors by conducting seminars, workshops and audits to assist in compliance efforts.

Negotiations with U. S. Department of Labor representatives to resolve charges of violations and/ or assessments of civil money penalties.

Litigation support services to attorneys by investigation of facts, application of the law and computations of any back wages that may be due, and as an Expert Witness.

From 1979 to 2006 I testified as a fact and/or expert witness in suits

filed by the US DOL before Administrative Law Judges.

 

Audit Services

Professional and technical expertise provided in connection with the conduction of audits, which involve a comprehensive evaluation, and analysis of compliance with the various requirements of the Fair Labor Standards Act (FLSA) and other labor laws. Particular emphasis is given to the integrity of FLSA classification system for exempt and non-exempt personnel relative to the payment of overtime or compensatory time and record keeping requirements.

Audits involve the analysis and evaluations of job descriptions and specific functional responsibilities of employees. Evaluations include the integrity of the exempt or non-exempt classifications under the FLSA and also include issues such as travel time, interrupted lunch periods, compensatory time accruals and usage, on-call or stand-by time, preliminary and postliminary activities, educational and training functions, and minimum working time requirements prior to crediting of working time for overtime or compensatory time requirements.
